We take your privacy very seriously. In this privacy notice, we seek to explain to you in the clearest way possible what information we collect, how we use it, and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy notice that you do not agree with, please discontinue use of our Services immediately. This privacy notice applies to all information collected through our Services (which, as described above, includes our Site).

1. What information do we collect?

In Short:We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our Services, when you participate in activities on the Site, or otherwise when you contact us. Personal information, or personal data, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymised data). Special category personal data (sometimes known as sensitive personal data) is a subset of personal data which, due to its nature, has been classified by law as deserving additional privacy and security protections and includes data relating to a person’s health and ethnicity.

The personal information that we collect depends on the context of your interactions with us. The personal information we collect may include the following:

  • Personal data including your name, date of birth, residential address, phone number, e-mail address, ethnicity, employment status, marital status, emergency contact details, data about your usage of the Services and data you provide in connection with using the Services. This will include data about your health that you provide to us and data we require in order to process your payments to us.
  • Device information and automatically-collected information such as your Internet Protocol (IP) address, browser, operating system version, system performance data, and device type, language preferences, referring URLs, device name, country, location, information about how and when you use our Site and other technical information are collected when you visit the Site. This information is primarily needed to maintain the security and operation of our Site, and for our internal analytics and reporting purposes.
  • Feedback forms, if you choose to engage with our feedback forms we will store your answers and any personal information you may provide us as part of that form such as name and e-mail address.

We may also ask you to provide clinical information by way of psychological and physical wellbeing questionnaires and other forms we provide following your therapy sessions with us. We will not store the information provided in these forms in a way that identifies you as the subject of the information (i.e. all information will be appropriately anonymised).

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information. Where we need to collect personal data under the terms of a contract with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with Services). In this case, we may have to cancel a Service you have with us but we will notify you if this is the case at the time.

2. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, your consent and/or other important reasons.

We use personal information collected via our Site for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or for compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We may process or share the data that we hold based on the following legal basis:

  • Consent: We may process your data if you have given us specific consent to use your personal information for a specific purpose. We will always obtain your express consent when collecting data relating to your health, ethnicity or other kinds of special category personal data (see section 1 above for more information about these types of personal data).
  • Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.
  • Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.
  • Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process.
  • Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in legal proceedings.

We use the information we collect or receive:

  • Fulfill and manage your appointments: We may use your information to fulfill and manage your appointment bookings and otherwise provide our Services.
  • To post testimonials: We post testimonials on our Site that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and the content of the testimonial. If you wish to update or delete your testimonial, please contact us at info@arianwellbeing.com and be sure to include your name, testimonial location, and contact information.
  • Request feedback: We may use your information to request feedback and to contact you about your use of our Services.
  • To respond to inquiries/offer support: We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.
  • To send you newsletters and other communications: We may use the personal information you send to us to send you newsletters and other communications if this is in accordance with your preferences. You can opt-out of our newsletter e-mails at any time (see the “WHAT ARE YOUR PRIVACY RIGHTS” below).

INTERNATIONAL TRANSFERS

We do not transfer your personal data outside the UK and/or the EEA.

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short: We will only share your personal information where necessary to provide our Services or if we have another good reason to do so.

We may share the data that we hold about you with our psychologists, therapists, personal trainers, and other members of the Arian Wellbeing team.

In addition, we may need to share your personal information in the following situations:

  • People at Risk: In the unlikely event that we believe you present an immediate or urgent risk to yourself or another person.
  • Illegal Activity: Where we have a duty to report suspicions of fraud or other illegal activity.
  • Business Transfers: In connection with, or during negotiations of, any merger, acquisition, or other transaction involving Arian Wellbeing.

In each case, we will only share your personal information with third parties as strictly necessary for these purposes.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

We do not currently use cookies or similar tracking technologies (like web beacons and pixels).

5. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as accounting or other legal requirements). We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

6. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Site is at your own risk. You should only access the Site within a secure environment.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

7. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from children under 18 years of age.

We do not knowingly solicit data from children under 18 years of age. By using the Site, you confirm that you are at least 18. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 8. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

You have certain rights under UK data protection laws. These may include the right:

  2. to request rectification or erasure,
  3. to restrict the processing of your personal information, and
  4. if applicable, to transfer your personal data/data portability.

If we are relying on your consent to process your personal information (including any special category data), you have the right to withdraw your consent at any time. 10. DO WE MAKE UPDATES TO THIS PRIVACY POLICY?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date, and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.
